Georgia’s Current Cannabis Law: Medical Only
Marijuana legalization and cannabis legalization can mean different things in different states. In Georgia, the current system is built around regulated medical access, not adult-use retail access.
Is recreational weed legal in Georgia? No. Georgia has not legalized recreational cannabis. Adults cannot walk into a Georgia dispensary and purchase THC cannabis products without first being registered through the state’s medical cannabis program.
And remember: just because you make a cannabis purchase in a state where recreational use is legal does not mean you can bring it back to Georgia and use it. Possession is still illegal here without a valid registry card, and transporting marijuana products across state lines is a federal offense.
What Changed: Georgia’s Program Was Just Overhauled
Georgia’s medical cannabis program looked very different a short time ago. As of July 1, 2026, Senate Bill 220 (the “Putting Georgia’s Patients First Act”) took effect and significantly expanded the program formerly known as the Low THC Oil Registry:
- The program and registry card are now called Medical Cannabis, not Low THC Oil.
- The old 5% THC cap has been removed. Registered patients may now possess more THC in approved products than before, within state-set limits.
- Patients can now access a wider range of product types, including raw flower intended for vaporization (smoking and public use are still prohibited).
- The state added lupus to the list of qualifying conditions.
Because this is a recent change, patients should always confirm current details like qualifying conditions, product types, and possession limits through official state resources or a licensed physician.
How to Qualify for a Georgia Medical Cannabis Registry Card
To access Georgia medical cannabis through the state program, you must first meet the program’s requirements.
The basic process usually looks like this:
- Find a licensed physician. In Georgia, only physicians who are fully licensed and whose main practice is based in the state can certify a patient for medical cannabis.
- Get certified for a qualifying condition. This certification is the only legal way to gain access to medical cannabis in the state, so there’s no way around seeing a licensed doctor first.
- Physician submits your information. Once your condition is certified, the physician uploads your details into the Medical Cannabis Patient Registry.
- DPH reviews your information. The Department of Public Health checks everything submitted to make sure it’s accurate and complete.
- Respond if contacted. If anything is unclear or missing, DPH will reach out directly for more information.
- Pay for your card. Once everything is verified, you’ll get an email with instructions on how to pay for your Medical Cannabis card.
The medical cannabis card is valid for five years. The expiration date is printed on the front of the card. After that time, you must consult with your physician to renew your card.
What Registered Patients Can Access
Registered patients with an active Georgia Medical Cannabis Registry Card may purchase approved THC cannabis products from licensed Georgia retailers.
